Chief Justice of India Chandrachud’s insights at HTLS 2023


During the Hindustan Times Leadership Summit 2023, Chief Justice of India DY Chandrachud discussed the retirement age of judges and compared the Indian model to the American Supreme Court. He stated that while the retirement age of judges in India is a matter for Parliament to decide, it is essential that judges retire. Unlike the American system, which has no age of retirement for judges, India follows a different model where judges retire. Justice Chandrachud emphasized the importance of judges passing on their responsibilities to succeeding generations as legal issues evolve.

Chandrchud on Judges’ Challenge

 

In a conversation with Utkarsh Anand, the national legal editor of Hindustan Times, Justice Chandrachud highlighted the challenges judges face. He mentioned that Supreme Court judges in India decide around 200 cases in a week, and the real challenge is balancing the workload and creating mental space to address crucial issues.

Justice Chandrachud also explained the role of the legislature in judicial decisions, stating that while the legislature can enact new laws to rectify deficiencies in judgments, it cannot directly overrule a court’s decision. He emphasized the distinction between what the legislature can and cannot do when a judgment has been made.

Furthermore, Justice Chandrachud noted that judges are guided by constitutional morality, not public morality when adjudicating cases. He mentioned that the judiciary has already disposed of a significant number of cases in the current year, with more work ahead.

CJI’s Best Wishes to Team India

In a lighter moment, when asked about his message for Team India in the ongoing Cricket World Cup, CJI Chandrachud extended his best wishes to the men’s cricket team led by Rohit Sharma, emphasizing their commitment to physical and mental fitness. He also praised their ability to maintain equilibrium and dedication, which extends to both the men’s and women’s cricket teams.
