The accused in rape cases are seeking leniency in Haryana and Punjab on the grounds that the intercourse was consensual, the Punjab and Haryana High Court has taken a strict measure to control it.
The court has made it clear that if the girl is below 16 , then consensual sex will also be considered as ‘Rape’.
The court in its verdict said “A minor girl can be lured into giving consent for such act without understanding its implications. Therefore, it is treated not as informed consent given after understanding the pros and cons as well as consequences of the intended action.”
This came after a man filed a plea against his conviction for raping a minor girl. The girl was 15 year old, he said the intercourse was consensual. But the court dismissed his plea and stated that consent sex with girl below 16 is a criminal act.
