The Supreme Court recently took a strong stand against comedians making insensitive jokes about persons with disabilities, asking them to apologize publicly on their social media platforms. This action came after a plea filed by SMA Cure Foundation, which highlighted offensive jokes made by popular comedians including Samay Raina, Vipun Goyal, Balraj Paramjeet Singh Ghai, Sonali Thakkar, and Nishant Jagdish Tanwar.
During the hearing, a bench consisting of Justices Surya Kant and Joymalya Bagchi reprimanded the comedians, emphasizing that humor should not come at the cost of hurting vulnerable communities. The bench specifically instructed, “Apology you tendered before the court, give the same before your social media too,” making it clear that public acknowledgment of their mistakes was necessary.
The case was listed alongside others involving influencers like Ranveer Allahabadia and Ashish Chanchlani, as the court considered the broader impact of public figures and their statements on society. Justice Bagchi highlighted that these influencers often “commercialize speech,” and that their humor can cross ethical boundaries when directed at marginalized communities.

“Humor is well taken and is a part of life. We laugh at ourselves. But when we start laughing at others and create a breach of sensibility…on a community plane, when humor is generated, it becomes problematic. And this is what so-called influencers of today should bear in mind. They are commercializing speech. The community at large should not be utilized to hurt the sentiments of certain sections,” Justice Bagchi said during the hearing.
The counsel representing the comedians informed the court that unconditional apologies had already been tendered before the judiciary. Justice Kant, however, raised concerns about future incidents, asking, “Next time tell us how much penalty we should impose on you.” The counsel responded, suggesting that any penalty should benefit disabled groups directly. Justice Kant further warned, “Today it’s about the disabled, next time it can be women, senior citizens, children…where will this end?” highlighting the broader societal implications of such jokes.
Senior Advocate Aparajita Singh, representing SMA Cure Foundation, welcomed the court’s directive and called it a strong message against insensitivity. She suggested that comedians could turn this apology into positive action by spreading awareness about disability issues using their platforms. “Good sense has prevailed (on the comedians), all have apologized. Your lordships have sent a strong message and it has gone home. They have apologized. My suggestion is let the comedians spread awareness about the issue. Let them use their influence to take this issue forward. That would be the best apology,” she said.

The court also insisted that the comedians extend their apologies beyond the courtroom, urging them to post apologies on their podcasts, YouTube channels, and other social media platforms. The order confirmed that each comedian undertook to comply, marking a notable instance where the judiciary addressed the responsible use of public platforms by influencers.
This ruling underscores the delicate balance between freedom of speech and social responsibility, emphasizing that humor must be exercised thoughtfully, especially when it concerns vulnerable communities. The Supreme Court’s intervention sends a clear message that public figures and comedians must be mindful of the impact of their words, reinforcing the principle that entertainment should never come at the expense of human dignity.
