SC overturned the Kerala High Court’s decision to stay MP Faizal’s conviction in the attempted murder case!

The SC overturned a Kerala High Court decision, suspending the conviction of MP Mohammed Faizal in an attempted murder case, remanding it for a new decision in six weeks.

The Supreme Court overturns the conviction suspension and mandates a six-week reevaluation in the MP Faizal attempted murder case.


On Tuesday, the Supreme Court overturned a Kerala High Court decision suspending Lakshadweep Lok Sabha MP Mohammed Faizal’s conviction and sentencing in a case involving attempted murder and remanded the issue back to the high court for a new decision to be made in six weeks.

On January 11, 2023, a sessions court in Kavaratti, Lakshadweep, condemned Faizal and three others to ten years of labour imprisonment and fined them each one lakh rupees for attempting to murder Mohammed Salih, the son-in-law of the late union minister P M Sayeed, in the course of the 2009 Lok Sabha elections.

Faizal had appealed the decision to the Kerala High Court, and on January 25 the HC postponed his conviction and punishment.

In its ruling, the high court stated that it was postponing the NCP leader’s conviction and punishment pending the outcome of his appeal against the trial court’s ruling. According to the statement, failing to do so would necessitate new elections for the position he has resigned, costing the government and the populace money.

On January 30, the Supreme Court decided to hear a plea from the Lakshadweep administration challenging the high court’s ruling.

In light of the Lok Sabha secretariat’s notification restoring his membership in response to the high court ruling, Faizal’s separate appeal against his disqualification as a Member of Parliament was dismissed by the top court on March 29.

On 22 August, the Supreme Court stated that the Lok Sabha MP’s conviction and imprisonment in the case were suspended due to the high court’s “erroneous” approach.

The MP was nonetheless shielded from any potential disqualification by a bench of Justices BV Nagarathna and Ujjal Bhuyan, who said that the earlier order’s protection would continue for an additional six weeks.

The high court will have to review its choice about the Lakshadweep government’s appeal within that time.
