The Bengaluru police have registered an FIR against Shilpa Shetty’s Bastian, a popular restaurant and nightlife spot in the city, for allegedly violating operational rules by staying open beyond permitted hours. The action was taken following a suo motu complaint by the police under Section 103 of the Karnataka Police Act, which governs public order and licensing conditions.
The FIR was registered at the Cubbon Park Police Station, as the establishment is located on St. Mark’s Road, a central and busy area of Bengaluru known for its nightlife and commercial activity.
Operating Beyond Permitted Hours
According to police officials, Bastian was found operating until 1:30 am on December 11, well beyond the stipulated closing time permitted under local regulations. Bengaluru has strict rules governing late-night operations of restaurants, pubs, and clubs, especially in residential and high-traffic zones.
Based on preliminary findings, cases have been registered against the managers and staff of the establishment for violating these norms. Police clarified that the FIR does not name patrons but focuses on those responsible for managing and running the venue.
Suo Motu Police Action Explained
The FIR against Bastian was filed based on a suo motu complaint, meaning the police acted on their own observation rather than a formal public complaint. Such actions are typically taken during routine night patrols or inspections aimed at ensuring compliance with licensing and safety regulations.
Officials stated that maintaining discipline around closing times is essential to manage law and order, traffic, and noise concerns, particularly in areas with dense residential populations.
Another Pub Also Booked
Apart from Bastian, the police also registered a case against Sour Berry Pub, located on Residency Road, for similar violations. As part of the investigation, statements were recorded from eight individuals, including members of the pub’s staff.
The police emphasized that the action is part of a broader enforcement drive against establishments flouting nightlife rules, and not targeted at any single business.
FIR Comes Amid Separate Legal Troubles
The FIR against Shilpa Shetty’s Bastian comes just weeks after Shilpa Shetty and her husband Raj Kundra were booked in a separate case by the Economic Offences Wing (EOW) in Mumbai.
In that case, the couple was accused of allegedly cheating a Mumbai-based businessman of Rs 60.4 crore in connection with a loan-cum-investment deal. An unknown individual was also named in the FIR.
The complainant, Deepak Kothari, alleged that he invested funds between 2015 and 2023 in a business venture linked to the couple’s now-defunct company, Best Deal TV Pvt Ltd, under the promise of expansion and returns.
Allegations of Financial Misuse
According to the complaint, the invested amount was allegedly misused for personal expenses instead of business purposes. The EOW is currently investigating the matter and examining financial records, cash flow statements, and corporate filings related to the company.
However, it is important to note that this financial case is separate and unrelated to the FIR registered against Bastian in Bengaluru.
Legal Response from Shilpa Shetty and Raj Kundra
Shilpa Shetty and Raj Kundra’s legal team has denied the cheating allegations, stating that the dispute is purely civil in nature. Advocate Prashant Patil, representing the couple, said that the matter had already been adjudicated by the NCLT Mumbai on October 4, 2024.
According to the lawyer, the company had faced financial distress and was involved in prolonged legal proceedings, but there was no criminal intent involved. He added that auditors had submitted all required documents, including detailed cash flow statements, to the EOW whenever requested.
Growing Scrutiny of Nightlife Establishments
The FIR against Bastian reflects increasing scrutiny of nightlife establishments in major cities like Bengaluru. Authorities have stepped up checks to ensure compliance with closing times, licensing conditions, and public safety norms.
Police officials have reiterated that celebrity ownership does not exempt any establishment from following the law. All restaurants and pubs, regardless of ownership, are subject to the same regulatory framework.
What Lies Ahead
Investigations into the rule violations at Bastian are ongoing. If found guilty, the management could face fines, further legal action, or restrictions on operating hours. Authorities have indicated that enforcement drives will continue in the coming weeks.
