Is a Government – Supreme Court battle in the offing?

Just today, India’s Supreme Court nixed a law passed by India’s parliament regarding appointment of Senior Judges by a ‘National Judicial Appointments Commission’, instead of the system of ‘Collegium’ followed for the last twenty years.




However, India’s Solicitor General made a statement saying that the collegium system was firstly not a part of the Constitution of India, and secondly, the system was ‘opaque’, wherein all those concerned in such appointments did not have a say.

He also reacted to the Supreme Court’s statement saying that they agreed that the system was faulty, and invited suggestions for it’s improvement by saying “Whether collegium system will be changed or not is in the wisdom of the court. But if it needs to be improved, it means it wasn’t correct in the first place.”
