SC To Hear Pleas Challenging Abrogation of Article 370

Abrogation of Article 370 has been challenged through many petitions and the SC is going to hear the pleas from 11th July. 

Abrogation of Article 370 Has Been Challenged By Many: What Will SC Say?


The abrogation of Article 370 which gave special status to Jammu and Kashmir was questioned by many people. In lieu of this, a five-judge constitution bench headed by Chief Justice of India D.Y Chandrachud will hear pleas challenging this abrogation from July 11. 

 

The bench will include Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai and Surya Kant. 

What was Article 370?

Article 370 of the Indian Constitution gave special rights to Jammu and Kashmir that allowed it to have a separate Constitution, state flag, and power over internal administration. On 5th August 2019, the Government passed a Presidential Order that made all provisions of the Indian Consitution applicable to Jammu and Kashmir, thereby taking away its special status. 

What do the pleas challenge?

More than 23 petitions were presented to the Supreme Court that challenged the abrogation of Article 370. People have challenged the unconstitutionality of the decision and the manner in which it was taken. These petitions say that proper procedures were not followed and the decisions of people were not taken into consideration. 

Shah Faesal, one of the petitioners says that he has withdrawn his petition. 

Shah Faesal, an IAS officer tweets- “370, for many Kashmiris like me, is a thing of the past. Jhelum and Ganga have merged in the great Indian Ocean for good. There is no going back. There is only marching forward.” 

In a phone interview with ANI, he also clarified “I have withdrawn the petition in the Supreme Court challenging the Presidential Order to scrap Article 370 long ago.”
