Supreme Court rules against LG in Delhi: Big Victory of Arvind Kejriwal
Finally, the tug – of –war between Centre and Delhi government comes to an end. The Supreme Court on Wednesday ruled that Lieutenant Governor Anil Baijal has no independent power to take a decision and is bound by the elected government’s advice. The decision was delivered by a five-judge bench led by CJI Dipak Misra.
The court further added that in a democracy, the real power must lie with the elected representatives of the people. The executive power of the state was co-extensive with its legislative powers, it said. It would have all powers except in three areas reserved for the central government – land, police and law and order.
The top court has also added that Delhi could not claim to be a state in the existing constitutional scheme. The decision is getting different reactions from the people of Delhi. But in any case, it is a big win for AAP Party.
After the decision was announced Arvind Kejriwal tweeted, “A big victory for the people of Delhi… A victory for democracy.”
Former Chief Minister Sheila Dixit too took to Twitter and shared her views. She said, “ I think what SC has said is very clear. As per article 239 (AA) of the constitution, Delhi is not a state, it is a union territory. If Delhi government and LG would not work together then Delhi will face problems. Congress ruled it for 15 years, no conflicts took place then.
